Kitten Purchase Contract

This agreement ("Contract") is made on this [date:   7/3/26] between [Seller's Name:         Melissa MacGregor ], hereinafter referred to as the "Seller," and

 [Buyer's Name:   ] hereinafter referred to as the "Buyer," collectively referred to as the "Parties."

1. Kitten Information:

 a. Breed: ragdoll

 b. Date of Birth: 4/29/26

 c. Color/Markings: solid chocolate 

 d. Gender: [male]

 e. Name (Charlie ): 

 f. Parents (maple+Hanu)

Kitten can go home on 8/13/26 You are welcome to pick up your kitten up at a later date but the balance must be paid in full and there will be a $20 a day care expense applied. I love my babies and they are more than welcome, but they are expensive to care for and raise!

2. Purchase Price and Payment Terms:

 a. The total purchase price for the kittens is $$$5900

 b. The Buyer has paid a 50%  deposit for the kitten . The balance will be paid upon pick up. This deposit guarantees kitten will not be  sold to another buyer), again deposit is non-refundable. Deposit can be applied to a different kitten under certain circumstances only upon approval by seller PLEASE INITIAL___________ (BUYER Initials) buyer will pay the balance in full at time of kitten pick up. 

 c. Payment shall be made by Venmo, Zelle, credit card or by Bank Wire Transfer. A 3.9 percent fee is applicant to all credit card transactions.

3. 2 year Health Guarantee: 

 a. The Seller guarantees that, to the best of their knowledge, the kitten is in good health at the time of sale. However, this contract does not include any allergy/food vs related issues. The seller has disclosed everything she knows health wise.

 b. The Buyer has 5 days from the date of take home to have the kitten examined by a licensed veterinarian. The buyer will provide proof of this check up or the health guarantee is void. If any significant health issues are found, the Buyer must notify the Seller within 3 days and provide a written veterinary report.

 c. If a significant health issue is confirmed, the Seller will provide a replacement kitten of equal value.

 d. The Buyer acknowledges that minor health issues, such as common respiratory infections or parasites are not covered in the warranty as they are easily contracted outside of the cattery and an infection may occur due to stress and exposure during the transition period.

NO kitten will be warrantied against feline herpes virus, feline chlamydia, panleukopenia, rhinotracheitis, or calici virus, as they are vaccinated against this and once a kitten leaves our cattery it is up to the new owner to avoid exposure to this and continue the required boosters of the FVRCP vaccine. NO KITTEN/CAT IS WARRANTIED AGAINST GIARDIA OR COCCIDIA THESE CAN BE PICKED UP WITHIN ANY ENVIRONMENT AS THEY LIVE IN SOIL. Desert Darlings RAGDOLLS WILL NOT BE RESPONSIBLE TO PAY ANY VETERINARIAN BILLS OR FEES. IF YOUR CAT OR KITTEN COMES DOWN WITH FIP AND YOU WISH TO DO THE MEDICATION THAT CAN BE FOUND ON FACEBOOK (FIP WARRIORS) THIS WILL BE DONE AT BUYERS EXPENSE IT IS NOT WARRANTIED AND WILL NOT BE PAID FOR BY BREEDER.

Before purchasing, the BUYER has the responsibility to ascertain that there are no known conditions that would require re-homing the kitten/cat. The BUYER hereby agrees that if at any time the BUYER cannot continue to take proper care of the kitten/cat, the BUYER must contact the SELLER/BREEDER, and the SELLER/BREEDER will have the first choice to either: (a) take the kitten/cat back or (b) assist the BUYER in finding a suitable home for the kitten/cat. If at any time the BUYER needs to return the kitten/cat to the SELLER/BREEDER, it must be with the SELLER/BREEDER’s permission and there will be a strict NO REFUND POLICY.

The SELLER/BREEDER will provide a (five) day limited health warranty that the kitten is in good health and free from feline leukemia virus (FeLV), feline infectious peritonitis (FIP), and the feline immunodeficiency virus (FIV) at TIME OF PURCHASE. These are highly virulent pathogens and cannot be warranted against any longer than the initial five days as they can be exposed in the new home environment or with other felines. FIP, FIV and FeLV are viruses and are NOT a warrantied reason. The SELLER/BREEDER also provides a (one) year guarantee against GENETIC DEFECTS that have been proven to have caused the kitten/cat’s death. IF ANY OTHER GENETIC DISEASES, CONDITIONS OR DISORDERS ARE FOUND IN YOUR KITTEN/CAT ALL DIAGNOSING OF CAT WILL BE DONE AT THE BUYERS EXPENSE. ALSO, THE ONLY REMEDY THAT DESERT DARLINGS RAGDOLLS CAN OFFER IS TO REPLACE YOUR CAT WITH A SUITABLE REPLACEMENT. IF YOU DENY WANTING TO DO THIS NO MONETARY REMEDIES WILL BE OFFERED OR GIVEN ___________ (BUYER Initials) SELLER/BREEDER. ___________ (Initials). 

Should this ever occur; the genetic defect must be certified by a licensed veterinarian’s NECROPSY will be required to confirm the cause of death. In the case of such an event, the BREEDER will replace the kitten/cat with a kitten of equal quality as soon as one is available from future unreserved litter. Travel for kittens under the warranty is buyer’s responsibility whether you choose to travel to pick up the kitten or to have the new kitten shipped/delivered it is BUYER’S RESPONSIBILITY 

Under no circumstances will Desert DARLINGS Ragdolls be responsible for any of the BUYER’s veterinarian expenses. The BUYER must notify the SELLER/BREEDER of any claim under the warranty within 24 (twenty-four) hours of the veterinarian appointment. 

The kitten may then be returned to the SELLER/BREEDER within five days at the BUYER’s expense in exchange for a new kitten. No refund will be provided.

The BUYER will not let the kitten/cat roam outdoors. It is understood that the kitten/cat is to be an indoor pet ONLY. 

4. Vaccination and Medical Records:

 a. The Seller will provide the Buyer with the kitten's vaccination records, including dates and types of vaccinations administered. 2 age appropriate vaccines are administered as well as proper deworming.

b. Do not get your kitten the FeLV and FIV vaccines. Your vet may recommend them but they are not necessary for indoor only cats. They have been shown to be harmful and fatal to the ragdolls sensitive systems. The 1 year health guarantee is void if the kitten receives either or both of these vaccines.

5. Spay/Neuter Agreement:

 a. The kitten should not be spayed/neutered before 5 months of age. This is to ensure the optimal health and happiness of your kitten. Once the kitten has been spayed or neutered Melissa will provide the TICA Registration papers. If proof of spay and neuter is not provided to the seller by 7 months of age this contract and any warranty is void.

 b. The Buyer must provide the Seller with proof of spay/neuter within 7 days of the procedure.

6. Breeding Restrictions:

 a. The Buyer agrees that the kitten is being purchased as a pet and not for breeding purposes. If found out that the contract has been violated and a litter has been produced whether intentionally or unintentionally. The buyer will pay the seller a $20,000 fee. Breeding is restricted, Unless otherwise stated.

7. Return Policy:

 a. At anytime from the date of purchase, the Buyer is unable to keep the kitten, the Seller will accept the return of the kitten.

 b. The Seller will not issue a refund for the kitten. All sales are final. Replacing a kitten will be up the sellers discretion.

 c. The Buyer is responsible for any transportation costs associated with returning the kitten.

8. Transfer of Ownership: Ownership of the kitten will be transferred to the Buyer upon receipt of full payment.

9. Legal Jurisdiction:

 a. This Contract shall be governed by and construed in accordance with the laws of the State of California.

 b. Any disputes arising from this Contract shall be resolved in the courts of California.

1. You Agree that the kitten will not be declawed as it is inhumane. A scratching post and regular claw trimming will be provided to the cat by the BUYER. If declawed, the BUYER’s rights under the provisions of this contract will be null and void, unless BUYER has received written permission from SELLER/BREEDER to declaw the cat, which would ONLY be granted in very rare circumstances. This constitutes a breach of contract, and the buyer agrees to pay the breeder $5000 for declawing a kitten which is against our policies and beliefs. All veterinarian care will be provided as needed at the cost of the buyer. SELLER WILL NOT PAY FOR ANY VETERINARIAN FEES REGARDLESS OF THE HEALTH CONCERN GENETIC/VIRAL/BACTERIAL, or MICROBIOLOGICAL.

The BUYER will provide companionship, taking into consideration the RAGDOLL’S unique need for companionship, and not leave the cat alone for long periods of time. 

1. The SELLER/BREEDER neither makes nor implies any warranties or guarantees, express or implied, other than those written in this agreement including, without limitation, the warranties of merchantability and fitness. This document constitutes the entire agreement between the SELLER/BREEDER and BUYER with respect to this sale. The Buyer's signature below indicates that he/she has read, agrees and understands all the conditions of the Sales Agreement and Contract of Sale. In the event of any dispute the venue for such dispute litigation is to be filed and heard in the county of the SELLER/BREEDER’s residence, named here as San Bernardino county. 2. Entire Agreement:

 This Contract constitutes the entire agreement between the Parties and supersedes any prior discussions or agreements, whether written or oral.

By signing below, the Parties acknowledge that they have read and understood the terms and conditions of this Ragdoll Kitten Purchase Contract and agree to be bound by its terms. By signing below, both BUYER and SELLER/BREEDER indicate they have read and agree with all of the provisions of the above contract.

WHEN KITTENS LEAVE OUR CATTERY, THEY CAN BE STRESSED, AND CAN HAVE BOUTS OF DIARRHEA (USE CANNED PUMPKIN TO STOP THIS) OR COULD COME DOWN WITH AN UPPER RESPIRATORY INFECTION (THIS REQUIRES A VET VISIT). PLEASE REMEMBER THESE ARE UNIQUE ANIMALS AND ARE SENSITIVE TO THEIR NEW ENVIRONMENTS. THEY CAN BE STRESSED. PLEASE DO YOUR BEST TO MINIMIZE THEIR STRESS. ALSO PLEASE REMEMBER WE ARE ALWAYS HERE FOR YOU TO REACH OUT TO AND TALK THROUGH ANY UNIQUE SITUATIONS THAT ARE GOING ON. GOD BLESS YOU AND YOUR NEW FAMILY MEMBER.
